Trade Notice No. 12/2007

Sub: -   Instruction for units manufacturing Panmasala, Gutkha and Chewing Tobacco-regarding”

Attention of the Trade, Industry and all others concerned  is invited to the instructions contained in the Trade Notice No. 10/2007 dated 11.09.2007 issued under Rule 31 of the Central Excise Rules, 2002, for the assessees manufacturing Pan Masala,  Gutkha and Chewing Tobacco.

2.                     The Central Board of Excise & Customs have noticed that in some cases the pan masala and gutkha manufacturing units have been found to be operating machines more in number than what they had declared in their declaration to the department. The manufacturer, in such case, may have taken the plea that they had intimated to the department by fax either a day or two earlier or on the same day about bringing new machines into the factory. In this regard, it is clarified that as per the instructions contained in para 2.4 of the Trade Notice No. 10/2007 dated 11.09.2007, an intimation is required to be filed to the Department, 24 hours before bringing in the said machines. In other words, the new machines should not be brought into the factory before expiry of 24 hours after filing of the intimation. Further, it is also provided that new machines shall be brought into the factory only after verification/authentication by the Range Officer or any other authorized officer.

3.         Any violation in complying with the above instructions would attract penal action as provided under the law.
